Zeepay Ghana Limited and its Managing Director, Andrew Takyi-Appiah, have filed a lawsuit against Scancom PLC, operators of MTN Ghana, and Mobile Money Fintech Limited (MMFL) at the High Court in Accra over the alleged registration of the company’s corporate mobile money wallet in the Managing Director’s personal name. The writ of summons, filed on October 23, 2026, seeks GH¢15 million in damages for Mr Takyi-Appiah, in addition to general damages for breach of contract on behalf of Zeepay.
According to the plaintiffs’ statement of claim, Zeepay subscribed to an MTN Mobile Money corporate wallet, known as an OVA wallet, sometime between 2022 and 2023. However, the company later discovered that the wallet had been registered in Mr Takyi-Appiah’s name, despite the fact that the subscription documents, including the Know Your Customer (KYC) records, were submitted in the company’s name.
The plaintiffs said Zeepay formally wrote to the defendants on November 21, 2023, requesting that ownership of the wallet be transferred to the company. They maintained that all required supporting documents were provided, but the defendants allegedly failed or refused to effect the change despite repeated follow-ups extending to August 2026.
They further stated that, as of the commencement of the lawsuit, the wallet remained registered in Mr Takyi-Appiah’s name. Mr Takyi-Appiah is seeking compensation for what he describes as pain, emotional distress and damage to his reputation arising from the situation. He contends that the disputed registration has resulted in his being personally drawn into legal proceedings involving Zeepay.
According to the claim, courts handling the company’s pending cases at the High Court in Accra have declined applications to remove him as a party because his name continues to appear in the wallet’s ownership records.
The plaintiffs also disputed the defendants’ alleged justification for registering the wallet in Mr Takyi-Appiah’s name, reportedly on the basis that he was its handler. They argued that the person designated to operate or manage an OVA wallet is not necessarily its legal owner.
Describing the defendants’ actions as “oppressive, arrogant and a complete disregard of the rights” of both plaintiffs, Zeepay and its Managing Director are asking the court to grant the reliefs sought in their action.
The plaintiffs are asking the court for:
- declarations that registering the wallet in his name was wrongful and unlawful, that the defendants breached their duty to Zeepay, and that they are liable for any harm he has suffered;
- an order directing the defendants to remove his name and comply with Zeepay’s November 2023 instructions;
- general damages for breach of contract for Zeepay;
- GH¢10 million in general damages and GH¢5 million in exemplary damages for Mr Takyi-Appiah; and
- costs, including legal fees, and any other orders the court considers fit.
The writ commands the defendants to enter an appearance within eight days of service. The claims have not been tested in court.
